This notice explains what personal information Prospect Fencing Supplies collects when you contact us through this website, why we collect it, how long we keep it, and what rights you have over it.
Who we are
Prospect Fencing Supplies, Standish, Wigan, WN6 0QP, United Kingdom. We are the data controller for the information described in this notice.
- Telephone and WhatsApp: 07840 349 621
- Email: [email protected]
What we collect
When you fill in an enquiry or quote form on this website we ask for some or all of the following, depending on the form:
- Your name
- Your company or organisation name, on our commercial enquiry forms
- Your phone number
- Your email address
- Your postcode or site postcode
- Details about the job, such as the type of fencing or gate, approximate run length or opening width, an indication of budget, site type and timeframe
- Anything else you choose to write in the message box
Our website also records some technical information with each submission so we can answer you properly and protect the forms from abuse: the date and time, the page you submitted from, your browser user agent and your IP address.
Why we collect it, and our lawful basis
- To prepare and send you a quote and to answer your enquiry. Our lawful basis is that processing is necessary to take steps at your request before entering into a contract, and where you are enquiring on behalf of a business, our legitimate interest in responding to a business enquiry.
- To arrange a site survey and carry out work you go on to instruct. Our lawful basis is performance of a contract.
- To keep records of quotes and jobs. Our lawful basis is our legitimate interest in running the business properly, and in some cases our legal obligations, for example keeping accounting records.
- To protect our forms from spam and abuse. Our lawful basis is our legitimate interest in keeping the website secure and usable.
We do not use your enquiry details for marketing unless you ask us to, and we do not sell your information to anyone.
Who we share it with
We share personal information only with the suppliers who help us run the business, and only so far as they need it:
- Our website host. Enquiries are stored in the website database on our hosting provider’s servers.
- Our email provider. Enquiry notifications are sent to our business inbox by email.
- Cloudflare. Our website uses Cloudflare to serve pages quickly and to protect the site, which means your request passes through their network.
- WhatsApp, if you choose to message us that way. Those messages are handled by WhatsApp under Meta’s own terms and privacy notice, not ours.
- Our accountant, and HMRC, where a quote becomes a paid job and the records form part of our accounts.
We will also disclose information if we are required to by law.
Transfers outside the UK
Some of the suppliers above are based outside the United Kingdom, or use servers outside it. Cloudflare and WhatsApp are the main examples. Where personal information is transferred outside the UK, we rely on the safeguards permitted under UK data protection law, which for these suppliers means either the UK Addendum to the European Commission’s standard contractual clauses or the UK Extension to the EU-US Data Privacy Framework. If you would like details of the safeguard that applies to a particular supplier, ask us and we will tell you.
How long we keep it
- Enquiries that do not become jobs: up to 24 months from your last contact with us, then deleted. We keep them this long because fencing enquiries often come back around after a season or a budget cycle.
- Enquiries that become jobs: for the duration of the work and then for 6 years after the end of the financial year in which the work was completed, to meet accounting and legal requirements and to support any warranty or workmanship question.
- Technical spam protection records: a short period only, typically no more than 12 months.
Spam protection on our forms
Our enquiry forms use built in spam checks that do not involve sending your details to a third party. These work by adding a hidden field that a real person never fills in, by measuring how long the form took to complete, and by limiting how many submissions can come from the same address in a short period. The date, time, page, browser user agent and IP address recorded with your submission are part of this protection as well as helping us reply to you.
Cookies and similar technologies
This website uses cookies and similar technologies that are strictly necessary to make the site work, to keep it secure, and to remember your choices while you browse. Our hosting provider and Cloudflare may also set technical cookies to serve pages and protect the site.
You can block or delete cookies through your browser settings. Blocking strictly necessary cookies may stop parts of the site, including the enquiry forms, from working properly.
We do not currently use analytics or advertising cookies on this website. If that changes, we will ask for your consent first through a cookie banner, and this notice will be updated to say what is being collected and why.
Automated decision making
We do not use your information for automated decision making or profiling. Every quote is prepared by a person.
Your rights
Under UK data protection law you have the right to:
- Ask for a copy of the personal information we hold about you
- Ask us to correct anything that is wrong
- Ask us to delete your information, where we do not have a legal reason to keep it
- Ask us to restrict how we use it, or object to us using it where we rely on legitimate interests
- Ask us to transfer your information to you or another provider, where that right applies
- Withdraw consent at any time, where we relied on consent
To exercise any of these rights, email [email protected] or call 07840 349 621. We will respond within one month.
Complaints
If you are unhappy with how we have handled your personal information, please tell us first and we will try to put it right. You also have the right to complain to the Information Commissioner’s Office, the UK regulator, at ico.org.uk or on 0303 123 1113.
Changes to this notice
If we change how we handle personal information we will update this page and change the date at the top.
